Welcome to Crystal Clear Media! These Terms of Service ("Terms") outline the rules and regulations for using our digital marketing services. By engaging with our services, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Definitions

• "We," "Us," or "Our" refers to Crystal Clear Media.

• "Client," "You," or "Your" refers to the individual or business entity using our services.

• "Services" means the digital marketing solutions we offer, including web design, app development, SEO, social media management, content creation, and other marketing services.

2. Acceptance of Terms

By accessing or using our services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to any part of the Terms, please discontinue using our services.

3. Scope of Services

We provide a range of digital marketing services, including but not limited to:

• Website design and development

• SEO (Search Engine Optimisation)

• Social media marketing and management

• App design and development

• Content creation and strategy

• Paid advertising (PPC, display ads)

The specific details and deliverables of our services will be outlined in a separate agreement or proposal provided to you prior to commencing work.

4. Client Obligations

• Accurate Information: You agree to provide accurate and up-to-date information as required for us to deliver services effectively.

• Approval Process: You are responsible for providing timely feedback, approvals, and access to resources necessary to complete the project.

• Content Ownership: You confirm that any content you provide for use in our services is owned by you or you have permission to use it.

5. Payment Terms

• Fees: The fees for our services will be detailed in the project proposal or agreement.

• Payment Schedule: Payments are typically due according to the terms laid out in the project proposal (e.g., upfront, milestone-based, or upon completion).

• Late Payments: Late payments may incur additional fees or result in a suspension of services until payment is received.

6. Project Timelines

We will provide estimated timelines for the completion of each project. However, these timelines may vary depending on the scope of the work, revisions, and your responsiveness in providing required materials and approvals.

7. Intellectual Property

• Ownership: Crystal Clear Media retains ownership of all intellectual property rights in any work produced as part of the services provided to the client, including but not limited to digital content, branding, and marketing strategies. The client is granted a non-exclusive, non-transferable license to use such intellectual property solely for the purposes of  their business. If the client does not wish for their materials to be used for marketing and promotional purposes, they must notify the Company in writing prior to accepting the quote.

• Third-Party Content: Any third-party tools, images, or software used in your project are subject to the licensing agreements of their respective owners.

8. Revisions and Changes

Revisions or modifications to a project may be requested during the design or development phases, as outlined in the project proposal. Additional revisions beyond the agreed scope may result in extra charges.

9. Use of Materials

 The client grants the Company the right to use any material  produced  as part of the services provided for marketing and promotional purposes, including but not limited to case studies, testimonials, and  samples of work. The client acknowledges that such use may involve disclosure of confidential information and hereby grants the Company a non-exclusive, royalty-free, worldwide license to use such materials for marketing and promotional purposes. The Company will make reasonable efforts to ensure that any use of such materials does not disclose confidential information or harm the client's business interests. If the client does not wish for their materials to be used for marketing and promotional purposes, they must notify the Company in writing prior to accepting the quote.

10. Confidentiality

We respect the confidentiality of your business information. Both parties agree to keep any proprietary or confidential information shared during the course of our work confidential, except as required by law.

11. Limitation of Liability

To the fullest extent permitted by law, Crystal Clear Media will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of profits, data, or business opportunities.

12. Termination of Services

• By Client: You may terminate our services at any time with written notice. Termination fees may apply based on the work already completed and outlined in the agreement.

• By Us: We reserve the right to terminate services if you breach these Terms or fail to provide required payments or resources in a timely manner.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website and will take effect immediately. Your continued use of our services following any changes constitutes your acceptance of the updated Terms.

15. QUOTE

Acceptance of Quote:  By accepting the quote provided by Crystal Clear Media (the "Company"), the client agrees to be bound by these terms and conditions.​

Scope of Work: The quote provided by the Company outlines the scope of work that will be performed for the client. Any changes or additional work requested by the client may result in additional fees and must be agreed upon in writing by both parties.​

Payment Terms:  The client agrees to pay crystal clear media the  quoted amount in full upon receipt of invoice, unless otherwise agreed upon in writing. If payment is not received within 30 days, the Company reserves the right to charge interest at a rate of 1.5% per month on the outstanding balance.

16. INVOICE​

​Payment due date: Unless otherwise agreed in writing, payment is due upon receipt.

​Payment methods: We accept payments by bank transfer. Payment details will be provided on the invoice.

Late payment fees: In case of late payment, we reserve the right to charge an interest rate of 8% per annum above the Swedish reference rate, as well as any additional costs incurred in the collection of the payment.​

Discounts: Unless otherwise agreed in writing, no discounts will be granted for early payment.​

Taxes:  All prices are exclusive of VAT unless otherwise stated on the invoice.​

Disputes: Any disputes related to invoices must be reported to Crystal Clear Media within 10 days of receipt of the invoice.
